List of Documents Required for Trademark Registration

The required documents vary depending on the type of applicant:

1. For Individuals

  • A copy of Aadhaar Card, or
  • PAN Card, or
  • Permanent Driving License.

2. For Startups

  • Startups must submit a Certificate of Recognition issued by the Department for Promotion of Industry and Internal Trade (DPIIT).

3. For Micro, Small, and Medium Enterprises (MSMEs)

  • MSMEs need to provide a Udyam Aadhaar Registration Certificate issued by the Ministry of MSME.

4. For Sole Proprietors

  • Sole proprietors are required to submit their Goods and Service Tax (GST) Certificate.

5. For Partnership Firms and Limited Liability Partnerships (LLPs)

->Partnership Firms:
  • Partnership Deed (if available), or
  • Optional: Udyam Aadhaar Registration Certificate,
  • GST Certificate.
->LLPs:
  • Incorporation Certificate of LLP, or
  • LLP Deed, or
  • GST Certificate, or
  • Optional: Udyam Aadhaar Registration Certificate.

6. For Private Limited Companies

  • Certificate of Incorporation, or
  • Optional: Udyam Aadhaar Registration Certificate.

7. For Hindu Undivided Families (HUFs)

  • Deed of Constitution of HUF, or
  • PAN Card of HUF.

8. For Societies

  • Societies must submit their Certificate of Registration issued by the Registrar of Cooperative Societies.

9. For Trusts

Trusts must furnish one of the following:

  • Trust Deed duly executed on a stamp paper, or
  • Trust Registration Certificate, or
  • PAN Card in the name of the Trust.

10. Common Documents for All Types of Applicants:

Regardless of the type of applicant, the following documents are generally required:

  • Power of Authorization of an Agent: Required when the trademark application is filed by a lawyer or a registered trademark agent.
  • Graphical Representation of the Trademark: This is essential as the representation influences consumer behavior and preferences.
  • User Affidavit: Needed when the applicant claims a specific date as the first use of the trademark. Supporting documents like commercial invoices or certificates related to business formation should also be submitted.
